These Rules and Procedures are provided to promote the satisfaction of all Resorts of Distinction members, and are designed to make the Resorts of Distinction Program easy to use and enjoyable. These Rules and Procedures do not apply to your Home Resort. Use of your Home Resort is governed by your membership agreement with your Home Resort. (Your Home Resort is where you purchased your resort membership. If you are a member of a chain of resorts, you are assigned the resort in that multi-resort system located closest to your home.) The Rules in new Resorts of Distinction directories supersede all prior publications and are part of your ROD membership agreement. The terms and conditions of this agreement and the Rules can be revised, modified or added to, in Resorts of Distinction’s sole discretion, if Resorts of Distinction believes such changes would be beneficial to the Resorts of Distinction program.

1. Home Resort

To become a member of Resorts of Distinction (ROD), you must first be a member in good standing at your Home Resort. Your Home Resort must also be affiliated with Resorts of Distinction. Use of your Home Resort, not use of ROD program, must be the primary reason you purchased your Home Resort membership. The agreement between you and ROD is separate and distinct from the agreement between you and your Home Resort. ROD does not own your Home Resort or any other ROD affiliated resort. If the contractual affiliation between your Home Resort and ROD is terminated for any reason, you may no longer participate in the ROD program.

2. Use of Affiliated Resort

You may use the facilities and services at any ROD affiliated resort. Site night fees are $10 per night. There is FREE CAMPING as long as you maintain a balance of $25 in your travel account. (Free camping does not apply to special promotion memberships.) Additionally, you are responsible for any rental unit charges and/or incidental charges you might incur. You will be charged the same rates the affiliated resort charges its own members. You are subject to all the rules and regulations of any affiliated resort you visit. The facilities and amenities at affiliated resorts vary, and may be different from your Home Resort.

3. Resort Quality

All affiliated resorts are independently owned and operated. Resorts of Distinction cannot guarantee that any affiliated resort will remain affiliated with Resorts of Distinction. Resorts of Distinction directory information is provided by affiliated resorts and Resort of Distinction believes all the information it contains is complete and accurate, but Resorts of Distinction is not responsible for errors or inaccuracies.

4. Annual Fee

You are required to pay Resorts of Distinction an annual fee if you wish to be a Resorts of Distinction member and participate in the Resorts of Distinction Program. Any member who allows their Resorts of Distinction membership to lapse for more than 90 days will be required to pay a reinstatement fee of $300.00 in addition to the current annual fee. There is no rebate or proration of membership fees. If your Resorts of Distinction membership expires you will not be eligible to renew the free camping option.

5. Travel Account

To travel in the Resorts of Distinction system you must activate your Travel Account by purchasing Travel Credits. Travel credits will be used for site night reservations, rental units, ancillary products, site night fees, etc. However, you can enjoy free camping (site night fees waived) if you have a minimum Travel Account balance of 25 Travel Credits. Anytime while the membership is active, or within one year after termination, you may request a refund of your Travel Account balance by sending a written request to: Resorts of Distinction, Travel Account Manager, P.O. Box 100, Valentines, Virginia 23887. A $5 administration fee will be imposed. Any travel credits remaining in the travel account one year after expiration of the membership are not refundable.

6. Nature of Membership

Your Resorts of Distinction membership and right to use affiliated resorts is solely for your recreation and enjoyment. Your Resorts of Distinction membership is neither sold nor purchased as a financial investment and you receive no interest in the contract rights, assets, or business of Resorts of Distinction. Resorts of Distinction does not purport to sell, lease or otherwise devise or convey any interest in any real property. You may own only one Resorts of distinction membership.

7. Availability

Use of affiliated resorts is on first-come (or first-reserved), first-served basis. Use of affiliated resorts is subject to space availability and ROD cannot guarantee that your request or reservation to use a particular resort at any particular time will be fulfilled.

8. Reservations

Call Resorts of Distinction Customer Service on 1-800-720-7633 to make your site night reservations at the affiliated resorts. Reservations are required and can be made up to 90 days in advance. There is no fee and you may have up to three (3) open reservations in the Resorts of Distinction system at any one time. (This would include a reservation currently being used at an affiliated resort.) Reservations for rental units are made directly with the resort you wish to visit. See “Reservations and Restrictions” section of each resort for resort reservation policy. Please remember that there is a “no show” fee of $25. 9. Length of Stay

You are entitled to 2 visits per year at each affiliated resort. You are able to stay up to 7 nights per visit at each resort. You may not use your 2 stays at a particular resort consecutively. There must be at least 1 week between visits to the same resort.

10. Family Use

ROD membership privileges extend only to the purchasing members and his/her immediate family. The immediate family is defined as the husband and wife and minor (under 21 years of age) children living at home. Responsible minor children who carry their parent’s Home Resort/ROD card and a parental letter of permission shall have full ROD program privileges.

11. Transferability

Your ROD membership is not transferable.

12. Membership Card

Members must present a valid Home Resort/ROD membership card before entering resort. Your card will indicate to the resort your Home Resort status, as well as your ROD status. Site night charges, if applicable (see section 5 above), will automatically be deducted from the travel credits you have placed in your Travel Account. You may add credits using your Visa, MasterCard or Discover Card by dialing the “800” number on the back of your card, or you may mail a check or money order payable to Resorts of Distinction, P.O. Box 100, Valentines, VA 23887.

13. Non-Responsibility/Limit of Liability

Resorts of Distinction is not a provider of accommodations and is not responsible for the physical or financial condition, or any other aspect of, its affiliated resorts or affiliated services, or for any statements made by any agent of any of its affiliated resorts or its affiliated services at the time a membership is purchased, or before or afterwards. Any representations concerning the Resorts of Distinction Program are limited to the written materials supplied or otherwise approved by Resorts of Distinction. Any other representations are not valid or binding upon Resorts of Distinction. Resorts of Distinction is not responsible for any personal or property damage resulting from acts, omissions or negligence of any affiliated resort or its employees or agents. The relationship between Resorts of Distinction and its affiliated resorts is governed strictly by the affiliation agreement between Resorts of Distinction and the resorts. Any claims regarding an affiliated resort shall be between you and the resort. Resort’s of Distinction liability to you, in any and all circumstances whatsoever, is limited to the amount you paid for your annual fee in the year such liability arose.

14. Governing Law

This agreement, and any dispute between you and Resorts of Distinction, shall be governed by the laws of the state of New York without regard to conflicts of law principles. Venue for any action at law or in equity shall be in Monroe County, New York. In the event you sue Resorts of Distinction for any reason and do not prevail, Resorts of Distinction shall be entitled to recover its attorneys’ fees and litigation expenses from you.
